Key changes to electronic disclosure are introduced in the new Practice Direction 31B, which comes into effect on 1st October 2010. Are you ready?

Disclosure has become the most expensive part of any litigation matter and given the hyperflow of information there is a very real risk of legal costs spiralling out of control.  The guiding principles in the new Practice Direction highlight the importance of minimising the burden and cost associated with disclosure and the role technology has to play in this.  The ESI questionnaire, formally introduced by the new Practice Direction, plays a key part in this.

This short breakfast seminar will provide an overview of the changes to the Practice Direction from a leading panel of experts, who are well placed to comment on the significant amendments.

Nick Burkill, Partner, Dorsey & Whitney
Nick is a partner and head of Dorsey's London trial department.  He completed two terms as a member of the Civil Procedure Rule Committee.  He served on the Senior Master's working party considering amendments to ESI disclosure procedure and on the CPRC's working party under Mr Justice Coulson considering the draft ESI Questionnaire.

Neil Mirchandani, Partner, Hogan Lovells
Neil is a partner in the Securities, Investment Banking and Funds Litigation Group at Hogan Lovells.  He is experienced in a broad range of City-related issues such as mergers and acquisitions, financial market problems and corporate and regulatory investigations.  Neil has considerable experience of the use of technology in large scale litigation and presented at the "Courtroom of the Future" debate and at LegalTech, London.

Daniel Kavan, Legal Technology Consultant, Kroll Ontrack
Daniel Kavan is a consultant within the Legal Technologies department at Kroll Ontrack.  His role is to advise lawyers and their clients on how to effectively manage paper and electronic disclosure exercises.  Daniel provides consultancy and training to assist clients in the examination and management of document intensive cases.
