
A short breakfast seminar outlining why the ESI Questionnaire is being introduced and how to be preapred for it
In the recent case of Gavin Goodale & Ors v The Ministry of Justice & Ors, Senior Master Whitaker published an ESI Questionnaire which is likely to form part of a new draft Practice Direction. It requires parties to provide information about documents they hold in electronic form and which are to be disclosed, along with details of their electronic storage systems. The questionnaire forms the basis for discussion between parties about the scope of the reasonable search for ESI (Electronically Stored Information) and any tools and techniques which might reduce the burden and cost of disclosure of ESI.
This short breakfast seminar will involve a discussion with a leading panel of experts, who will consider the impact the ESI Questionnaire will have on the Disclosure process.

He served on the Senior Master's working party considering amendments to ESI disclosure procedure and on the CPRC's working party under Mr Justice Coulson considering the draft ESI Questionnaire.
